By accessing or using this website (“Site”) operated by Mag5 Firearms LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use this Site. 

  1. Eligibility & Legal Compliance

You must be legally eligible to purchase firearms, ammunition, and related products under federal law, Pennsylvania law, and all applicable local and state laws. 

By placing an order, you certify that: 

  • You are at least 18 years old to purchase ammunition and accessories 
  • You are at least 21 years old to purchase handguns 
  • You are not prohibited from possessing firearms or ammunition 
  • All information you provide is true, accurate, and complete 

Mag5 Firearms LLC does not provide legal advice and makes no representation that products are legal in all jurisdictions. 

  1. Firearms Sales & FFL Transfers

All firearm purchases must be shipped to a valid Federal Firearms License (FFL) holder selected by the customer. 

  • Firearms will not be shipped directly to customers 
  • Customers are responsible for ensuring the selected FFL is willing and able to receive the firearm 
  • Transfer fees are set by the receiving FFL and are not included in the purchase price 
  • Background checks are conducted by the receiving FFL, not Mag5 Firearms LLC 

If a firearm transfer is denied, delayed, or canceled for any reason, Mag5 Firearms LLC is not responsible for associated fees or delays. 

  1. Restricted Items & State Laws

Certain firearms, magazines, ammunition, and accessories may be restricted or prohibited in certain states or local jurisdictions. 

Customers are solely responsible for compliance with all applicable laws. Orders placed for prohibited items may be canceled without notice and may be subject to restocking fees. 

  1. Orders, Pricing & Payment
  • All prices are subject to change without notice 
  • We reserve the right to cancel or refuse any order 
  • Pricing or typographical errors may result in order cancellation 
  • Payment must be received in full prior to shipment 

Accepted payment methods are displayed on the Site. 

  1. Shipping & Delivery
  • Firearms ship only to FFL holders 
  • Ammunition and accessories ship only where legally permitted 
  • Shipping times are estimates and not guaranteed 
  • Risk of loss transfers upon delivery to the carrier or FFL 
  • We Do Not Ship/Sell to the Following States – Alaska, Hawaii, California, Connecticut Illinois, Maryland, New York, New Jersey, Washington and Washington D.C. 

Mag5 Firearms LLC is not responsible for shipping delays, lost packages, or carrier errors once the shipment has left our possession. 

  1. Returns, Refunds & Cancellations

Firearms: 

  • All firearm sales are final 
  • Returns accepted only for verified manufacturer defects 

Ammunition & Accessories: 

  • Must be unused and unopened 
  • Subject to restocking fees 
  • Shipping charges are non-refundable 

Orders canceled after shipment may incur additional fees. 

  1. Product Use & Safety Disclaimer

Firearms and related products are inherently dangerous. 

By purchasing from Mag5 Firearms LLC, you acknowledge: 

  • You understand safe firearm handling and storage 
  • You assume all risks associated with use or misuse 
  • Mag5 Firearms LLC is not liable for injury, death, or property damage resulting from product use 

Always follow manufacturer instructions and firearm safety rules. 

  1. Limitation of Liability

To the fullest extent permitted by law, Mag5 Firearms LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of this Site or products sold. 

  1. Intellectual Property

All Site content—including logos, text, images, graphics, and branding—is the exclusive property of Mag5 Firearms LLC and may not be used without written permission. 

  1. Prohibited Use

You may not: 

  • Use this Site for unlawful purposes 
  • Attempt to circumvent security features 
  • Provide false or misleading information 
  • Resell products where prohibited by law

Any legal action shall be brought exclusively in state or federal courts located in Pennsylvania.
